Terms of Service and Sale

Durgical at durgical.app is operated and maintained by RC Capital Partners LLC, a limited liability company registered in the State of New Jersey, United States, 210 Westervelt Ave, North Plainfield, NJ 07060, United States ("we", "us"). Durgical and its logo are used with permission of Durgical SAS.

These terms are an agreement between you and RC Capital Partners LLC. They cover the Durgical app at durgical.app and any paid plan you buy there. By creating an account or buying a plan, you accept them.

1. What Durgical is

Durgical is an educational, stylized 3D anatomy and procedure app for students. It is for self-study only.

  • The models are representative models, for educational purposes only. They do not show any real patient's anatomy and simplify or stylize some structures.
  • Durgical is not a medical device and is not for clinical use. Do not use it to diagnose, plan or carry out treatment, prepare for a specific patient's surgery, or make any other clinical decision.
  • Durgical does not replace your teachers, your textbooks or a qualified health professional's judgement.
  • Durgical is not a school. It is not a formal education programme and does not lead to a degree, a professional licence or continuing-education credits (CE/CME).

2. Who can use Durgical

You must be at least 16 years old. If you are under 18, you confirm that your parent or legal guardian has agreed to these terms and to the Privacy Policy. Durgical is not directed to children under 16, and we do not knowingly collect their data.

3. Your account

Keep your sign-in secure; you are responsible for activity on your account. One account is for one person. You can delete your account at any time from My account.

4. Plans and prices

  • Free plan, no card needed: the 3D anatomy and DurgiPedia without limits, up to 10 saved notes, 5 questions and 5 photos of notes a day to Durgi, study-card generation in Estudiar twice a week, and 2 GB for your lecture PDFs and images.
  • Durgical Plus: US$4.99 per month or US$39.99 per year: unlimited notes, 100 questions and 30 photos of notes a day to Durgi, 40 GB for your lecture PDFs and images, and the other Plus features shown on the pricing page.
  • We may raise these limits at any time. If we lower a Plus limit, we will tell you at least 30 days before, and you can cancel before then.
  • Prices may be shown in US dollars or your local currency at checkout. Taxes (VAT/IVA/IGV) are added or included as the checkout shows.
  • Prices are always shown before you pay. If we change a price, we will email you at least 30 days before it applies to your next renewal, and you can cancel before then.

5. Payments: Paddle is our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders: you buy the subscription from Paddle, which handles payment, billing, invoices, sales tax/VAT and payment-related questions, and handles refunds under our Refund Policy. Your purchase is also subject to Paddle's Buyer Terms. We never see or store your full card number. Charges appear on your statement under Paddle's name (for example, PADDLE.NET* DURGICAL).

6. Renewal and cancellation

  • Subscriptions renew automatically at the end of each period (month or year) at the price you agreed to, until you cancel. We tell you this at checkout and in your receipt.
  • Cancel anytime, online, in one step: in My account, or through the "Manage subscription" link in any Paddle receipt. No call, no email and no reason needed. You keep Plus until the end of the period you already paid for; after that, there are no more charges and your account moves to the free plan. Your notes stay yours.
  • Yearly plan: we email you a reminder 15 to 45 days before each yearly renewal, with the price and how to cancel.
  • No hidden renewals, and no free offers that turn into paid plans without your clear choice.

7. Refunds and right to cancel

See our Refund Policy. In short: a full refund within 14 days of any payment, no questions asked. This is at least as generous as the right to cancel under the consumer laws of Colombia (Law 1480 of 2011), Mexico, Peru, Chile and Argentina, and does not limit any right the law gives you.

8. Your notes and content

Your notes, flashcards and study plans are yours. We store them to provide the service (for example, to sync them and to build your review cards) and for nothing else. You can export or delete them at any time. Do not put patient data or anyone else's personal health information in your notes.

Files you upload (for example, lecture PDFs or images) are also yours and only you can see them. Only upload material you have the right to use, such as your own class material or material your teachers give you to study; you are responsible for what you upload. Don't upload documents with patient data or photos of patients. If we receive a well-founded notice that a file infringes someone else's rights, we may remove it and will tell you.

9. AI study features

Some features (the Durgi assistant and Estudiar) use an AI model to answer questions and to build cards and plans. They are only on if you turn them on. If you ask, Durgi can also tidy up or summarize a note, or turn a photo of your notes into text; your note only changes if you accept the changes. AI answers can be wrong: check them against your course materials. They are educational, never medical advice. Don't write or photograph patient data.

10. Acceptable use

Do not use Durgical for anything illegal; try to access other people's accounts or data; scrape, overload or reverse-engineer the service; resell or share your account; or use automated tools to make AI requests.

11. Licences and credits

  • The app, its code, text and design belong to us, except as stated below. The Durgical name and logo belong to Durgical SAS and are used with its permission. We give you a personal, non-transferable licence to use the app while your account is active.
  • Many 3D models are adapted from Z-Anatomy / BodyParts3D, licensed CC BY-SA 4.0. The models we modified from them are shared under the same CC BY-SA 4.0 licence, with credit; copies are available on request at info@durgical.com. Your subscription pays for the app and its features, not for those models.
  • Some models come from the HuBMAP Human Reference Atlas (CC BY 4.0, credit to their creators) and MakeHuman (CC0). Names follow Terminologia Anatomica (TA2) and DeCS.
  • Full credits: Credits.

12. Completion badges

Durgical may show a completion badge saying you finished a module and the estimated hours of self-study. It is a record of your own self-study only. It is not an academic or professional credential, is not accredited by any school or authority, and gives no CE/CME credits.

13. Independence

Durgical is educational and brand-neutral: it does not promote or recommend any product, brand, company or manufacturer, and nothing in the app is a product claim. Durgical SAS, which permits the use of the Durgical name and logo, is not the seller of the app and is not a party to these terms.

14. Availability and changes

We may improve, change or retire features. If we remove something important you paid for, you can cancel and get a prorated refund for the unused time. We may suspend accounts that break these terms; we will tell you why, unless the law prevents it.

15. Warranty and liability

Durgical is provided "as is" for education. We work to keep it accurate, but anatomy models and summaries may contain errors or omissions; tell us at info@durgical.com. To the extent the law allows, our total liability for any claim is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the consumer laws of your country that cannot be waived.

16. Law and disputes

These terms are governed by the laws of the State of New Jersey, United States. This does not take away the consumer protections of the country where you live that cannot be waived, and you can always go to your own consumer authority (SIC in Colombia, Profeco in Mexico, INDECOPI in Peru, SERNAC in Chile, Defensa del Consumidor in Argentina) or its courts.

17. Changes to these terms

We will email you and show a notice in the app at least 30 days before an important change takes effect. If you don't agree, you can cancel before then.
